GENERAL TERMS AND CONDITIONS OF SALE – HOTEL


PREAMBLE
These general terms and conditions of sale (“GTC”) apply to any reservation made directly with the Hotel for a maximum of 9 rooms. This includes reservations made on the website, by email, by phone, or at the Hotel reception.
The “Hotel” refers to Hotel OstÒria | 8 rue de la Borderie | 24430 Marsac-sur-l’Isle
The “Client” refers to any individual making a reservation on the website for private or professional purposes.
The Client acknowledges having read all necessary information regarding the nature, destination, and booking procedures for services available on the website. Should this not be the case, the Client will have requested the necessary services and received all additional information beforehand to make their reservation with full knowledge. Any reservation made via the website implies full acceptance of the GTC.
The GTC may be supplemented by specific terms of sale appearing in the service description, as well as by the terms of sale of service providers, accessible either on their website or on-site.

I – CAPACITY
The Client acknowledges having the legal capacity to contract, meaning being of legal age and not under guardianship or curatorship.
The Client also declares to use the site in accordance with these GTC, in their own name and on behalf of all beneficiaries of the services ordered by them on the Site, for whom they acknowledge being the agent (hereinafter: the “Beneficiaries”), and to whom these GTC shall be enforceable.
The Client is financially responsible for the use of the Site made both in their own name and on behalf of the Beneficiaries, unless they can demonstrate fraudulent use not resulting from any fault or negligence on their part.
The Client guarantees the truthfulness and accuracy of the information provided by them in their own name and on behalf of all Beneficiaries using their data on the Site.
The Hotel reserves the right at any time not to contract with a Client who makes fraudulent use of the Site or who violates these GTC.


II – RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L 121-21-8 of the Consumer Code, the services offered on the Hotel’s website are not subject to the right of withdrawal provided for in Articles L. 121-21 et seq. of the Consumer Code concerning distance selling.
Consequently, services ordered on the site are exclusively subject to the cancellation and modification conditions set out in these GTC, and the Client may not invoke the right of withdrawal.


III – PRICES

Prices are indicated in Euros. VAT is included in the proposed rates. Any change in the applicable rate, or any modification or introduction of new legal taxes imposed by the competent authorities, will be automatically reflected in the prices indicated on the billing date.
The prices indicated only include the services strictly mentioned in the reservation. To the price mentioned in the reservation will be added any additional services provided by the hotelier during the stay and, where applicable, the tourist tax.
The prices mentioned on the site are subject to change at any time by the Hotel without prior notice. Only the price indicated in the reservation confirmation by the Hotel is contractual.
No stay reserved before the implementation of a potential promotional offer will be subject to a refund, even partial.


IV – ONLINE ORDERS
Any reservation of more than 9 rooms may entail special conditions (rates, cancellation conditions, payment conditions).

Confirmation of the order implies acceptance of these terms of sale, acknowledgment of having full knowledge thereof, and waiver of one’s own purchase conditions or other conditions.
All data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute signature and acceptance of the operations performed.
The Hotel will send the Client, by any means (email or standard mail), confirmation of the recorded order.
The reservation is firm and definitive only after receipt of the confirmation sent to the Client by the Hotel.
The rates, terms, and conditions of a reservation are intended for the sale of hotel rooms in accordance with their primary purpose (accommodation). The hotel reserves the right to modify the rates, terms and conditions, or simply to cancel the reservation, if the rooms are used for other purposes such as photo shoots, film shoots, showrooms, or interviews…


V – ONLINE PAYMENT METHODS
Depending on the type of reservation made, the full price is due at the time of placing the order (prepayment) or at the end of the Client’s stay at the Hotel (flexible plan).
In all cases, and to guarantee their reservation, the Client is asked to provide their credit card number, with the transmission being made via a secure method.
In case of payment at the time of placing the order, the credit card information transmitted by the Client via a secure system to the Hotel allows the latter to debit the card for the total amount of the stay, always securely. The Client’s bank account is debited on the day of the order, with the invoice being sent by the Hotel to the Client at the end of their stay, on the day of their departure.
Please note that the credit card used to make the reservation must be presented upon arrival by its holder. Failing this, a new credit card will be requested for payment upon arrival.
In the event that all or part of the stay is covered by a third party, the amount defined by the latter must be paid before the Client’s departure.
Please also note that the hotel reserves the right to pre-authorize your credit card at any time before your arrival (flexible plan).
The tourist tax remains to be paid on-site, on the day of arrival or departure.

VI – THE STAY
Check-in (arrival): Rooms are available to the client from 3:00 PM on the day of arrival.
Check-out (departure): Unless otherwise agreed, the client must vacate their room by 11:00 AM on the day of departure. (Otherwise, the hotel reserves the right to charge an additional night).
I – Full Cancellation:
A change in the stay date is considered a full cancellation and is subject to the cancellation conditions.
Under the flexible plan, the reservation can be canceled free of charge up to 24 hours before the start date of the stay.
Less than 24 hours before the arrival date, the pre-authorization made 48 hours before the arrival date will be debited.
II – Partial Cancellation:
In the event of a shortened stay, a postponed arrival date, a modified number of people, or any other fact modifying the original reservation contract, the deposit paid will neither be refunded nor deducted from the invoice, as it constitutes a cancellation fee.
Under the flexible plan, the balance of the originally reserved stay will be requested.
In case of a no-show (a non-canceled reservation, client not present), the Hotel reserves the right to debit 100% of the stay price from the card used as guarantee at the time of reservation.

VII – NON-SMOKING POLICY
Please note that our Hotel and all its indoor areas are entirely non-smoking, including rooms, even with an open window.
The general smoking ban in hotels and restaurants has been applicable in France since 2008-01-02 in all public places, meaning the entire Hotel when it specifically states that it is entirely non-smoking.
Any offender will be subject to a penalty of €250, which will be directly debited from the credit card provided as guarantee (loss of revenue due to the hotelier’s inability to re-rent the room for the 2 nights following the departure of the smoking client / mandatory cleaning of all fabrics / carpet shampooing / wall washing). Furthermore, all costs incurred by the hotel for reimbursements due to inconvenience caused by the fire alarm to other guests will be fully debited from the credit card provided as guarantee.

VIII – PETS
Medium-sized dogs weighing no more than 12kg are allowed in all Hotel rooms. For any pet, the Client will be required to pay a supplement of €10 per night.


IX – RELOCATION
In case of unavailability of the Hotel or in case of force majeure, the latter reserves the right to accommodate the Client, entirely or partially, in a nearby hotel of equivalent or superior category, offering services of the same nature. The transfer will then be at the Hotel’s expense, and the Hotel cannot be sought for payment of any additional compensation.

X – FORCE MAJEURE
Force majeure is understood as any event external to the parties, both unforeseeable and insurmountable, which prevents either the Client or the Hotel from fulfilling all or part of the obligations stipulated in the contract.
It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party bears the costs arising therefrom.
Clients shall bear solely the additional costs that may be incurred to allow the continuation of the trip, following the occurrence of a force majeure event.



XI – COMPLAINTS
Any complaint must be sent to the following address: OstÒria | 8 rue de la Borderie | 24430 Marsac-sur-l’Isle, within 15 days following the departure from the stay to which the complaint relates. After this period, no complaint will be taken into consideration.


XII – DATA PROTECTION AND FREEDOM
In application of Law 78-17, known as “Data Protection and Freedom,” clients are informed that their reservation is subject to computerized personal data processing. Clients have a right to access and rectify the data entered, which can be exercised at the head office: OLYTIS | 17 chemin d’Engauthier | 24600 RIBÉRAC. It is specified that this information is not communicated to third parties.
The Hotel offers Wi-Fi internet access. The Client undertakes that the IT resources made available to them shall in no way be used for the reproduction, representation, making available, or public communication of works or objects protected by copyright, or by a related right such as texts, images, photographs, audiovisual musical works, software, and video games, without the authorization of the rights holders as provided for in Books I and II of the Intellectual Property Code when such authorization is required.

XIII – LIABILITIES
The Hotel declines all responsibility in case of theft, loss, or damage to clients’ belongings during their stay.
The Client will be held responsible for any damage, degradation, or act of vandalism that may occur due to the occupation of the premises and/or due to the participants and/or staff for whom they are responsible, whether to movable, decorative, or immovable property belonging or not belonging to the Hotel. Consequently, the Hotel has every right to ask the Client to leave the establishment without any compensation and without any refund for the current stay, and to be reimbursed for damages caused by these acts. In the online sales process, the Hotel is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary problems.



XIV – INTELLECTUAL PROPERTY
The content of the Hotel’s website is the property of the Seller and its partners and is protected by French and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and may constitute an act of infringement.


XV – APPLICABLE LAW

These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and procedural rules. Disputes shall fall under the exclusive jurisdiction of French courts.

GENERAL TERMS AND CONDITIONS OF SALE – WELLNESS AREA AND POOL

I – ACCESS TO OUR FACILITIES
i – Wellness Area
A reservation is mandatory to enjoy our Wellness Area; only those who have reserved and paid for their access upon arrival or during their stay, subject to availability, may use our facilities.
Children under 16 years old are not permitted in the Wellness Area.
Sauna use is strictly prohibited in case of cardiovascular disease. If you have a history of such conditions, we strongly recommend seeking medical advice. By accessing the facilities, you confirm that you are in good health and are not violating any medical advice prohibiting your access to our facilities.
ii – Outdoor Pool
Access to the outdoor pool is included for any Client with a Hotel room reservation. This access is governed by internal regulations which the Client acknowledges having read before entering the pool.

II – DRESS CODE
Swimwear is mandatory. For men, briefs, boxers, and swim shorts are permitted.
i – Wellness Area
We require the use of single-use slippers, provided to Clients. No other footwear may be worn in the Wellness Area. A towel, also provided, must be used in the sauna.
ii – Outdoor Pool
A swim cap is not mandatory. Long hair must be tied up to access the pool.


III – BEHAVIOR
i – Wellness Area
It is imperative to take a soapy shower before accessing the facilities.
Keyed lockers are available in the changing rooms; we ask you to leave all your personal belongings inside. The Company is not responsible for loss or damage due to heat and humidity if you bring your jewelry, electronic devices, etc., with you.
i – Outdoor Pool
Passing through the footbath is mandatory to access the outdoor pool.
Running around the pool, jumping, or diving is prohibited.
To respect everyone’s tranquility, please keep your mobile phone on silent mode.
We disclaim all responsibility in the event of an accident resulting from non-compliance with safety rules and internal regulations.


IV – CANCELLATION
For any cancellation or change of time slot, please notify us at least 24 hours in advance. Otherwise, access to the Wellness Area will be charged in full.
In the event of a delay on your part, we will strive to adjust your access time if the schedule permits. Otherwise, we will be obligated to reduce the duration of your access to avoid impacting the subsequent client, with no price reduction.
